Workers’ Compensation Claims

Your employer is required by law to provide workers’ compensation benefits if you get hurt on the job. In California, these benefits can include: medical care, temporary disability benefits, permanent disability benefits, and vocational rehabilitation. Death benefits may be available to dependents of a worker who dies from a job–related injury or illness. This may include good faith members of the household and partial support provided to certain family members living outside of the household.

Temporary disability benefits are payments if you lose wages because you cannot do your usual job while recovering. If you cannot recover completely and have become limited in your ability to work, “permanent disability” payments may be available. How long these payments are received depends upon the extent of injuries as well as a rate table.

How We Can Help You

If you have a serious injury, consulting an attorney can help keep your workers’ compensation claim on track. A law firm can plan a strategy for your case, gather information to support your claim, keep track of deadlines, and represent you at hearings before the Workers’ Compensation Appeals Board.

You may be unhappy with the quality of medical care that you are getting from your employer’s doctor or the employer’s insurance company or having trouble with getting benefits paid. A good legal team will work on maximizing your benefits and helping you get needed medical assistance.

At Brayton Purcell, we are experienced in handling workers’ compensation claims, including those based on asbestos exposure, beryllium exposure, construction injuries, and repetitive stress syndrome. We are particularly knowledgeable about asbestos–related illnesses, and can explore any options that you may have beyond a workers’ compensation claim. If you have an employment–related injury, please feel free to contact us to learn more about your legal rights.
